By applying for and maintaining a B2B account with KushStar Inc. ("KushStar"), you ("Customer") agree to be bound by the following terms and conditions:
B2B accounts are available only to licensed retail or wholesale businesses operating within Canada. By applying, you confirm that you are authorized to enter into this agreement on behalf of your business and that your business is in compliance with all applicable federal, provincial, and municipal laws and regulations, including those related to the sale, purchase, and distribution of vaping and smoking products.
Customer agrees to comply with all relevant laws and regulations pertaining to the purchase, sale, storage, and distribution of vaping and tobacco-related products, including, but not limited to:
The Customer shall be solely responsible for ensuring that all vaping products purchased from KushStar are stored, marketed, and sold in full compliance with all applicable Canadian federal and provincial regulations, including, without limitation, the Excise Duty framework for vaping products.
In the event that KushStar incurs any fine, penalty, loss, or legal cost (including but not limited to CRA assessments, audits, legal fees, and damages) due to the Customer's failure to comply with applicable laws or misrepresentation of their business activities, the Customer agrees to fully indemnify and hold harmless KushStar, its affiliates, directors, officers, and employees from and against all such losses, liabilities, claims, or demands.
KushStar shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or resale of its products. Products are sold "as-is" and "as available" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
The Customer is responsible for maintaining the confidentiality of their account credentials and for all activities conducted through the account. KushStar reserves the right to suspend or terminate accounts that it deems in breach of these terms or any applicable law.
All products and prices are subject to change without prior notice. KushStar does not guarantee the availability of any product at any given time. Orders are subject to approval and product availability.
All returns must be authorized and are subject to KushStar's return policy. The warranty for any retailed device is 180 days from the date of sale. Any products purchased beyond this period will not be credited. Any missing or damaged glass products must be reported within 48 hours of receipt. Warranty claims will be processed only with relevant product pictures and proofs. Discrepancies or disputes must be reported within 3 business days of receiving the order.
KushStar may terminate or suspend a B2B account at any time, without prior notice, for breach of these terms or any legal or regulatory concerns.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. The parties agree to submit to the exclusive jurisdiction of the courts located in Quebec for any legal proceeding arising out of this agreement.
By submitting an application for a B2B account, the Customer acknowledges that they have read, understood, and agreed to be legally bound by these Terms and Conditions.
